1. Acceptance of Terms

By creating an account or using Giftr, you confirm that you are at least 13 years old and agree to comply with these Terms. If you do not agree to these terms, please do not use our service.

2. Description of Service

Giftr is a gift management platform that helps you organize gift-giving. Our service includes:

• Recipient Management: Create and organize profiles for people you give gifts to
• Occasion Tracking: Track birthdays, holidays, and other gift-giving events
• AI-Powered Recommendations: Receive personalized gift suggestions based on recipient preferences
• Shopping Tools: Manage shopping lists, track purchases, and access retailer links
• Profile Sharing: Generate links so recipients can update their own preferences

3. Account Registration

To use Giftr, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or appear to be fraudulent.

4. Free and Subscription Plans

Plan Tiers

Giftr offers a freemium model with two plan tiers:

• Free: Unlimited AI gift searches on the landing page with no account required. Search as often as you like.
• Giftr Pro: $5 per month or $48 per year. Includes recipient profiles, occasion tracking, email reminders, shopping lists, wish lists, gift history, budget tracking, and more personalized AI recommendations.

AI Gift Search

AI-powered gift search is available to everyone for free on the Giftr landing page. Giftr Pro subscribers also get access to more personalized recommendations based on saved recipient profiles and preferences.

Billing and Payments

For Giftr Pro subscriptions:

• Subscriptions are billed at $5 per month or $48 per year
• Your subscription will automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time; access continues until the end of your current billing period
• Prices may change with 30 days' notice for existing subscribers

Refund Policy

We want you to be satisfied with Giftr:

• You may request a refund within 7 days of your initial Giftr Pro subscription purchase if you're not satisfied
• Partial month refunds are not provided for mid-cycle subscription cancellations
• Free Plan users may upgrade to Giftr Pro at any time

5. AI Recommendations Disclaimer

Important: Gift recommendations provided by Giftr are generated by artificial intelligence based on the information you provide about recipients. Please understand that:

• Recommendations are suggestions only, not guarantees of recipient satisfaction
• AI recommendations may occasionally be inaccurate, inappropriate, or unavailable
• You are solely responsible for the final gift selection and purchase decision
• We do not guarantee product availability, pricing, or quality from third-party retailers
• Recommendations do not constitute professional advice of any kind

The quality of recommendations depends on the accuracy and completeness of recipient preference information you provide.

6. Affiliate Links Disclosure

Giftr participates in affiliate marketing programs. This means:

• Many product links in our recommendations are affiliate links
• We may earn a commission when you make purchases through these links
• This comes at no additional cost to you
• Affiliate relationships do not influence our AI recommendation algorithms
• Purchases made through affiliate links are transactions between you and the retailer

We are not responsible for products, shipping, returns, or customer service issues with third-party retailers. Please review each retailer's policies before purchasing.

7. User Conduct

You agree not to:

• Use the service for any unlawful purpose or in violation of these Terms
• Create accounts using false or misleading information
• Share your account credentials with others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools to scrape, extract, or manipulate our service
• Interfere with the proper functioning of the platform
• Upload harmful code, malware, or malicious content
• Abuse the AI recommendation system (e.g., excessive requests, manipulation attempts)
• Harass, abuse, or harm other users

8. User Content

You retain ownership of the content you create within Giftr, including recipient profiles, notes, and preferences. By using our service, you grant us a limited, non-exclusive license to:

• Store, process, and display your content as necessary to provide the service
• Share recipient data with AI systems to generate recommendations
• Use anonymized, aggregated data to improve our services

You are responsible for ensuring you have the right to enter information about recipients into our system. Do not enter sensitive personal information about others without appropriate consent.

9. Profile Sharing and User Matching

Giftr offers features that allow information sharing:

• Shareable Links: You can generate links that allow recipients to view and update their preference profile. Anyone with the link can access that profile.
• User Matching: If you enable discoverability in your profile, other Giftr users can find and link to your profile when adding you as a recipient. Your preferences become read-only for them.

You control these sharing features through your settings. Be mindful of what information you share through these features.

10. Intellectual Property

The Giftr service, including its design, features, code, content, and branding, is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or attempt to extract source code
• Create derivative works based on our platform

11. Third-Party Services

Giftr integrates with third-party services including payment processors, AI providers, email services, and retailers. Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the actions, content, or policies of third parties.

12. Disclaimer of Warranties

GIFTR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The service will be uninterrupted, secure, or error-free
• AI recommendations will be accurate, appropriate, or well-received
• Products recommended or linked will be available, in stock, or as described
• The service will meet your specific requirements

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIFTR AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Costs of purchasing substitute products
• Damages arising from gift recommendations or purchases
• Any damages exceeding the amount you paid us in the past 12 months

14. Indemnification

You agree to indemnify and hold harmless Giftr and its affiliates from any claims, damages, losses, or expenses arising from your use of the service, your violation of these Terms, or your infringement of any rights of another party.

15. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the service will immediately cease
• Remaining subscription time will not be refunded (except as required by law)
• We may delete your account data according to our data retention policy

You may delete your account at any time through your account settings.

16. Governing Law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Giftr shall be resolved in the courts of South Carolina.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the service at least 30 days before the changes take effect. Your continued use of Giftr after the effective date constitutes acceptance of the updated Terms.
